1. Introduction

These Terms & Conditions ("Terms") govern your use of the Stems & Tales website and services operated by Maa Harsiddhi Flower Decorators, located in Sagar, Madhya Pradesh, India.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services

Stems & Tales provides an online platform for ordering and delivering:

• Fresh flower bouquets and arrangements
• Cakes and baked goods
• Gift hampers and combos
• Plants and green gifting
• Add-on items (chocolates, soft toys, greeting cards, etc.)

Our delivery service is currently available within Sagar city and surrounding areas in Madhya Pradesh. You can check serviceability by entering your pincode during checkout.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 18 years old to create an account and place orders.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Orders & Pricing

4.1 Placing Orders

• All orders are subject to availability and delivery serviceability.
• By placing an order, you agree to pay the total amount including product price, delivery fee (if applicable), and any applicable taxes.
• Order confirmation will be sent via email and/or SMS.

4.2 Pricing

• All prices are listed in Indian Rupees (INR) and are inclusive of GST where applicable.
• We reserve the right to change prices at any time without prior notice. However, price changes will not affect orders already confirmed.
• Promotional prices and coupon discounts are subject to specific terms and expiry dates.

4.3 Product Accuracy

• We strive to display accurate product images and descriptions. However, since our products are handcrafted from fresh, natural ingredients, slight variations in colour, size, and arrangement are natural and expected.
• In case of seasonal unavailability, we may substitute specific flowers with alternatives of equal or higher value while maintaining the overall design aesthetic.

5. Delivery

• Delivery Timeslots: You may select from available time slots during checkout (Morning, Afternoon, Evening, Night, Same-Day, Midnight).
• Delivery Attempts: We will attempt delivery once at the provided address. If the recipient is unavailable, we may leave the order with a neighbour or at a safe location, or attempt to contact the recipient by phone.
• Incorrect Address: We are not responsible for failed deliveries due to incorrect or incomplete addresses provided by the customer.
• Force Majeure: Delivery may be delayed due to extreme weather, natural disasters, strikes, or other circumstances beyond our control. In such cases, we will make every effort to notify you and reschedule.
• Free Delivery: Orders above ₹999 qualify for free delivery within our serviceable area.

6. Payment

• We accept payments via UPI, credit/debit cards, net banking, Google Pay, PhonePe, and Cash on Delivery (COD) where available.
• All online payments are processed securely through third-party payment gateways. We do not store your card details.
• For COD orders, full payment must be made to the delivery partner at the time of delivery.

7. Cancellation & Refunds

Our cancellation and refund policies are detailed on our Refund & Cancellation Policy page. By placing an order, you agree to the terms outlined therein.

8. User Conduct

When using our website, you agree not to:

• Provide false or misleading information.
• Use the platform for any unlawful or fraudulent purpose.
• Attempt to interfere with the security or functionality of our website.
• Scrape, copy, or reproduce any content from our website without permission.
• Use abusive, threatening, or obscene language in personal messages, reviews, or communication with our team.

9. Intellectual Property

All content on the Stems & Tales website — including logos, brand name, product images, descriptions, page designs, and code — is the intellectual property of Maa Harsiddhi Flower Decorators and Moops Designs. Unauthorised reproduction, distribution, or use is strictly prohibited.

10. Reviews & User Content

• By submitting a review, you grant us a non-exclusive, royalty-free licence to display it on our website.
• Reviews must be honest, relevant, and based on genuine order experiences.
• We reserve the right to remove reviews that are abusive, defamatory, irrelevant, or suspected to be fake.

11. Limitation of Liability

• Stems & Tales shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.
• Our total liability for any claim related to an order shall not exceed the amount paid for that specific order.
• We are not liable for allergic reactions or health issues arising from the consumption of any products ordered (cakes, chocolates, etc.). If you have known allergies, please inform us before placing your order.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Sagar, Madhya Pradesh.
